1. We respect your privacy

1.1. I'm Nutrients Pty Ltd ("I'm Nutrients", "we", "us" or "our") respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors. We handle personal information in accordance with the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs"). This policy sets out how we collect, hold, use and disclose your personal information, and how you can access it, correct it or make a complaint.

1.2. "Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true and whether or not it is recorded in a material form.

1.3. Some personal information we collect is "sensitive information" (for example, health information). We only collect sensitive information with your consent and where it is reasonably necessary for our functions or activities, or as otherwise permitted by law.

2. The kinds of personal information we collect

2.1. The personal information we collect may include:

  • your name, delivery and billing address, phone number and email address;
  • order, payment and transaction details (payment card details are processed by our payment providers — see clause 6);
  • account, subscription and login details;
  • your communications with us, including feedback, reviews, survey responses and customer-support enquiries;
  • your marketing and contact preferences; and
  • where you choose to provide it, health-related information about you or the child for whom you are purchasing (for example, when you ask us a product-suitability question).

2.2. We may also collect technical and website information as described in clause 9.

2.3. You do not have to provide your personal information to us, but if you do not, we may be unable to process your order, provide our products or services, or respond to your enquiry.

3. How we collect your personal information

3.1. We collect personal information directly from you wherever reasonable and practicable — for example, when you place an order, create an account, subscribe to communications, complete a form, leave a review, or contact us electronically or in person.

3.2. We may also collect personal information from third parties, such as our e-commerce platform (Shopify), payment processors, freight and logistics providers, and marketing and analytics providers. If we collect your information from a third party, we handle it in accordance with this policy.

4. Why we collect, hold and use your personal information

4.1. We collect, hold and use personal information to:

  • process and deliver your orders and manage subscriptions;
  • provide customer support and respond to your enquiries, feedback and complaints;
  • manage your account and our relationship with you;
  • send you updates, offers and marketing communications where permitted (see clause 5);
  • improve our products, services and website and better understand our customers; and
  • comply with our legal obligations.

4.2. We will only use your personal information for the purpose for which it was collected, a directly related secondary purpose you would reasonably expect, or where you have consented or the use is otherwise permitted or required by law.

5. Direct marketing

5.1. We may contact you with marketing communications by email, SMS, telephone or post where you have consented or where we are otherwise permitted to do so.

5.2. Every marketing email and SMS we send includes a simple way to opt out, and you can unsubscribe at any time by using that mechanism or by emailing us at support@imnutrients.com. We will action your request promptly. Our electronic marketing complies with the Spam Act 2003 (Cth), and our telemarketing (if any) complies with the Do Not Call Register Act 2006 (Cth).

6. Disclosure of your personal information

6.1. We may disclose your personal information to:

  • our employees, officers, contractors and professional advisers, where reasonably necessary;
  • service providers who help us operate our business, including our e-commerce platform (Shopify), payment processors, freight, delivery and fulfilment providers, IT and cloud-hosting providers, email/SMS and marketing platforms, analytics and advertising providers, and review platforms;
  • a purchaser or potential purchaser in connection with an actual or proposed sale, merger or transfer of all or part of our business or assets (subject to appropriate confidentiality protections); and
  • government, regulatory or law-enforcement bodies, courts, or other third parties where required or authorised by law (for example, to comply with a law, regulation, court order, subpoena or warrant), or to protect our lawful rights, property or safety or those of our customers or others.

6.2. We require our service providers to handle your personal information consistently with this policy and the Privacy Act.

7. Overseas disclosure

7.1. Some of our service providers store or process personal information outside Australia, including in the United States and other countries where our cloud, e-commerce, payment, marketing and analytics providers operate. Before disclosing personal information overseas, we take reasonable steps to ensure recipients handle it consistently with the APPs.

8. Security, retention and data breaches

8.1. We take reasonable physical, electronic and organisational steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure.

8.2. We retain personal information only for as long as it is needed for the purposes set out in this policy or as required by law (for example, taxation and consumer-law record-keeping). When personal information is no longer needed and we are not required to retain it, we take reasonable steps to destroy it or permanently de-identify it.

8.3. No method of transmission over the internet or electronic storage is completely secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security, and any transmission of information to us is at your own risk.

8.4. If a data breach occurs that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act, including notifying affected individuals and the Office of the Australian Information Commissioner ("OAIC") where required.

9. Our website

9.1. Information collected automatically. When you visit www.imnutrients.com, we may collect information such as your browser type, operating system, IP address, the website you visited before ours, and pages viewed. We generally use this information in aggregated form to analyse how our website is used so we can improve it.

9.2. Cookies and tracking. We use cookies and similar technologies to operate the website, remember your preferences, analyse traffic and deliver and measure advertising (including through third-party services such as Google and Meta). Most browsers accept cookies automatically, but you can adjust your browser settings to reject cookies; if you do, some parts of the website may not work properly.

9.3. Analytics and advertising. We use third-party analytics and advertising services that may set cookies and collect information about your activity across sites to help us measure performance and show you relevant ads. These services are subject to their own privacy policies.

9.4. Third-party sites. Our website may contain links to sites we do not own or control. We are not responsible for the privacy practices of those sites and encourage you to read their privacy policies.

10. Children's privacy

10.1. Our products are purchased by adults for use by children, and our website and store are directed to adults. We do not knowingly collect personal information directly from children. If you believe a child has provided us with personal information, please contact us at support@imnutrients.com and we will take reasonable steps to delete it.

11. Automated decision-making

11.1. We do not use automated processes to make decisions that have a legal or similarly significant effect on you without human involvement. If this changes, we will update this policy to explain the personal information used and the nature of those decisions, consistent with our obligations under the Privacy Act.

12. Accessing and correcting your personal information

12.1. You may request access to the personal information we hold about you, and ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. Please email us at support@imnutrients.com.

12.2. There is no charge for making a request. We may charge a reasonable cost for giving access to information, but the charge will not be excessive and we will not charge you for making the request or for correcting your information. We will respond within a reasonable period.

12.3. In some circumstances the Privacy Act permits us to decline a request for access or correction. If we do, we will tell you why in writing and explain how you can complain.

13. Complaints

13.1. If you have a complaint about how we have handled your personal information, please contact us at support@imnutrients.com. We take complaints seriously and will acknowledge and respond to your complaint within a reasonable period.

13.2. If you are not satisfied with our response, you may contact the OAIC at www.oaic.gov.au or 1300 363 992.

14. Changes to this policy

14.1. We may update this policy from time to time. The current version will always be posted on our website, with the "last updated" date shown at the top. We encourage you to review it periodically.
